Making a Will is one of the most important things you can do. This will outline how you wish your most personal possessions and hard-earned savings to be passed to your family and friends.

If you don’t have a Will this could result in difficulties for those left behind as the law will determine how your estate will be distributed after your death – this is known as intestacy. It is particularly important to leave instructions if you own a property.

If you do plan to write a Will, we would strongly recommend you seek legal advice to ensure the document is correctly prepared . This will help avoid any pitfalls and ensure the document is valid. The Will should include who you wish your Executor to be (the Executor is the person responsible for carrying out your wishes in terms of your Will), who your possessions and assets should be given to, and (if relevant) how your children under 16 should be cared for. You may also wish to include your funeral arrangements.

Powers of Attorney

If you lose capacity whether through illness or accident, no one has an automatic right to make important decisions on your behalf. A Power of Attorney gives your chosen Attorney the legal authority to act on your behalf. This can include important decisions about your money, property, health and welfare. We understand it is difficult to think you might one day be unable to make decisions for yourself, however, by putting a Power of Attorney in place, this allows you to ensure your future is entrusted to the right person to act in your best interests, at a time when you are no longer able to take care of your own affairs. If you are thinking about arranging a Power of Attorney, instructing Frederick & Co will ensure this document is drafted, signed, and registered with the Office of Public Guardian in Scotland.

Where do I start?

A medical certificate must be received from a GP or hospital so the death can be registered. Once this is actioned, funeral arrangements can begin.

The next step is to check if a Will is in place. If a Will has been made, an Executor(s) will be named who will be responsible for managing the deceased’s estate.

In Scotland it may be necessary to obtain “Confirmation” of the deceased’s estate (in England this is known as Probate) so the executor can deal with any money and property that belonged to your loved one. We can lodge an application with the Sheriff Court on your behalf to deal with this swiftly.
