What if there is no Will – intestate estate?
If there is no Will in place, the law sets out how the deceased’s assets will be distributed and the procedures that must be followed. This is known as intestacy and can be a complex and demanding process without an experienced executry professional to guide you. Can my sale proceeds be transferred to another person if I ask you to?
Being strictly governed by Law Society of Scotland, we are only permitted to pay sale proceeds to the person (or people) who are on the Title deeds to the property. In a joint transaction, we can pay to one or the other person, only if we have signed authority from the person who is not receiving payment. Under no circumstances can we pay money to somebody who is not directly connected to the sale.
When will I receive my sale proceeds?
We require to redeem your existing loan (if there is one), account for all known costs associated with your transaction and prepare your post completion statement before transferring the free proceeds to your nominated account. In terms of our terms of business, you will receive your proceeds no later than 3 working days after the settlement date.
I paid for a CHAPS transfer, so why are the funds not in my account yet?
A CHAPS transfer is a same day payment. What we cannot guarantee is the time the funds will hit your account, which can be any time up to the end of the banking day. Please note that the banking day does not end at 5pm, with CHAPS able to credit accounts up to 6.30pm.
The redemption figure you have provided seems to include an Early Repayment Charge (ERC) which I am not due to pay. Why have you not taken account of that?
We require unambiguous confirmation from your lender in good time for completion that your ERC is being waived if that is the case. Please arrange to pass this confirmation to your legal team as early in the transaction as you can. If this is not available in good time for completion, the simplest route to take is for the ERC to be paid, and, should your lender assess it is not due after settlement, then they will refund you.
Why are you charging me ADS?
You will generally pay ADS when:
- you buy a residential property in Scotland and you already own one or more residential properties anywhere in the world
- if there are two or more buyers: if any buyer already owns one or more residential properties anywhere in the world
- you are not replacing or selling your ‘only or main’ residence

I am transferring funds to Frederick & Co, Should I check details before sending?
Yes. Before sending any funds, please check the details with your legal team or our terms of business letter that includes our firms account details. PLEASE NOTE that our bank account details will not change during the course of a transaction, and we will not change our bank details via email
I am due cashback. Why have you not included that on my pre completion statement?
Some lenders send funds after settlement as opposed to before, and some also pay directly to the Client, hence, we do not factor these sums into the amount required from you. If there is a cashback deal and the funds are received by us, then we will repay that sum to you upon receipt.
What time will I get the keys to my new property on the Date of Entry.
There is generally no fixed time for key release. It is dependent on a number of things which happen on or around the date of entry including when loan funds arrive from your lender (if you have one); settlement paperwork being delivered to your solicitor; and when the seller is clear of the property. Your legal team will let you know when and where your keys can be collected. We usually suggest that settlement will be around 12 noon to 2pm although this should not be taken as definite.
